Our Services
What we do
CASL is an expert in creating tailored litigation finance solutions for disputes and has decades of experience of doing so. Our team has extensive experience funding and managing the following types of claims:
CASL is also prepared to consider bespoke funding solutions for the following scenarios:
Class Actions
A class action proceeding involves a lead plaintiff or applicant bringing an action on behalf of a large group with similar claims, typically seeking compensation. Common examples include investor actions, product liability and other consumer claims, and mass tort actions. In exchange for funding the upfront legal expenses of these claims, the funder receives a share of any settlement or judgment, and claimants pay nothing if the case is unsuccessful. Funding thereby facilitates access to justice for individuals who might not have the resources to pursue litigation, an avenue to hold large corporations accountable, and a means of reducing the financial risks for plaintiffs and law firms.
Insolvency
Litigation funding for insolvency claims allows liquidators or administrators to pursue legal actions on behalf of an insolvent company without using limited remaining assets. The funder covers legal costs and, in return, receives an agreed share of any recovered funds, with no repayment required if the case fails. The key benefits include enabling claims that would otherwise be unaffordable, maximising returns for creditors, and reducing financial risk for insolvency practitioners.
In addition to providing funding for these legal proceedings, CASL will also consider the purchase and assignment of claims.
Commercial Claims
Litigation funding for commercial claims enables businesses to pursue strong claims without upfront costs or financial risk, as the funder absorbs the loss if the case is unsuccessful.
The key benefits include improved cash flow, risk mitigation, and access to experienced funders who provide strategic insights to strengthen the claim.
Law Firm Portfolio Facilities
Law Firms that have an interest in availing the Group Cost Orders (GCO) regime for class action litigation in the Victorian Supreme Court may seek portfolio facilities to enable them to participate with financial confidence demonstrable to the Court.
Subrogated Recoveries
Insurers with rights of subrogation to recover policy losses against third parties can bundle their claims into a portfolio. A tailored litigation funding solution can help them recover the value of these claims.
Arbitration
Third party funding may also be an option in the context of commercial arbitration, facilitating financial support for legal expenses and mitigation of risk.
